California Proposition 65 Acknowledgement and Agreement
Thank you for your continued business with Iconex LLC for your label needs. This agreement is a follow-up to our previous communication, “Iconex Proposition 65 Compliance” regarding the base thermal paper containing Bisphenol S (“BPS”) used in many of our products.
The principle behind thermal printing technology involves a printhead heating thermal coated paper with chemicals. A chemical frequently used to create the thermal coating is Bisphenol S commonly referred to as (“BPS”).
The State of California has determined that exposure to BPS can increase the risk of reproductive harm to those persons exposed to that chemical. Because of this determination, the State of California requires that a warning be provided to any consumers before they are exposed to BPS. In July 2024, we began placing warnings on the packaging for BPS-containing thermal paper.
That warning is:
“WARNING: This product can expose you to chemicals including Bisphenol S, which is known to the State
of California to cause birth defects or other reproductive harm. For more information go to
www.P65Warnings.ca.gov.”
Exposing a consumer to a listed chemical, such as BPS, without a warning subjects the seller or issuer to penalties, including attorney fees. That includes consumer handling of thermal paper containing Bisphenol S (BPS), wherein a warning on the packaging may not suffice.
By submitting an order to Iconex LLC for products that may contain BPS, you are (a) acknowledging that Purchaser has been informed of the requirements of the State of California, (b) agreeing that any penalty or attorney fees award imposed as a result of the Product being sold or distributed in California will be the sole responsibility of and paid by Purchaser, and (c) agreeing to defend, indemnify, and hold Company harmless from and against all third-party claims against Company arising in any manner out of your use or sale of the Product in violation of this Acknowledgment and Agreement.
